Our Services
"We are an ASX-list biotech company and FAL is effectively our in-house counsel. They recently developed a win-win commercialisation strategy for us with an international partner, managing the complexity - both legal and cultural - in a way that maintained our very good relationship with our partner."

MANAGING AND COMMERCIALISING NEW TECHNOLOGIES
New innovations often occur more quickly than the law can keep up with. However, FAL’s lawyers have an unrivalled understanding of the evolving framework in new areas of law.
We are intimately familiar with the different ways to commercialise IP, including licensing (with various degrees of exclusivity), assigning IP, start-up companies funded by venture capital and commercial collaborations. We are therefore well-placed to help scientists, investors and those wishing to commercialise new ideas determine the best way to go to market.
Some examples of the way we have worked with scientists, investors and those wishing to commercialise new ideas include:
- Developing a win-win commercialisation strategy for a bio-tech firm with an international partner
- The transfer of intellectual property in therapeutic technology from a number of research organisations and consortia to a start-up entity. The entity was later acquired by a major international publicly-listed company
- Developing and commercialising drug technology for a range of therapeutic applications with major Australian pharmaceutical companies
- Undertaking the licensing and commercialisation arrangements for a pharmaceutical product to treat various types of cancer
- Acting for a spin-off of a CRC to commercialise innovative manufacturing technology for application in the vehicle and metal industry
- Advising in monitoring technologies like the commercialisation of aircraft taxiway and airborne predictive mineral monitoring systems
- Advising in relation to the carbon sequestration technology, used in the site remediation of former coalfields
- Acting for several small, medium and large organisations in the commercialisation of software, including draft agreements for the development, licensing and maintenance of retail software, and on line selling systems
- Drafting and advising in the licensing of technologies, including the establishment of spin off and manufacturing companies
- Drafting software access agreement for a start-up company offering services in the primary industry advisory field
- Drafting an agreement for a major publicly listed company regarding the licensing of software for use in an offshore joint venture
- Advising and preparing agreements for the licensing of software in the aviation industry
- Trade Marks and Domain Name Disputes
We have particular expertise in managing IP when it comes to acquiring and using rights in Information Technology, including:
- Software Development Agreements
- Software Licences
- Escrow Agreements
- Website Development Agreements
- Website Disclaimers
- Procuring IT facilities and network access
- Securing Domain Names (URLs)
